Banta. <br />Division Director <br />Brief Summary of Agreement <br />Between the Colorado Mined Land Reclamation Division and <br />The Rock castle Company, dated June 26, 1990 <br />I. Reclamation Activities <br />- Rock castle will conduct reclamation at the site according to the <br />existing permit and the terms of the agreement. This includes <br />completing some technical studies and then conducting work based <br />upon the outcome of those studies. Rock castle reclamation work is <br />to be completed by November, 1990. <br />II. Bond Release and Forfeiture <br />- Rock castle bond will be released according to a schedule outlined <br />in the agreement based upon their performing the work stated in the <br />agreement. At the completion of all work outlined in the agreement <br />Rockcastle will forfeit E50,000 bond. Division will maintain and <br />administer the site through liability period using the E50,000 <br />forfeited bond. <br />III. Limitation Of Liability <br />- Rock castle will reduce liability at the site in response to the <br />December 14, 1989 Board Order and in order to abate NOV C-90-007. <br />- Following forfeiture Rock castle will no longer be subject to civil <br />or criminal penalties. <br />- MLRD has reserved the right to pursue enforcement of NOV's C-89-034 <br />and C-90-007, and the December 14, 1989 Board Order if Agreement is <br />not fulfilled by Rock castle. <br />- MLRD has preserved its full authority and ability under the Act and <br />the Rules and Regulations to pursue additional reclamation funds if <br />the forfeited amount is insufficient to complete any additional <br />reclamation that may be necessary. <br />Y. Modification and Dispute Resolution <br />- Written consent of MLRD and Rockcastle to modify agreement. <br />- Disputes will be resolved by the Board. <br />8394E/scg <br />
