PR-4 PRELIMINARY ADEQUACY REVIEW 2.03.4 Identification of Interests We have reviewed the ownership and control information provided in the Tab 3 amendments and conducted an initial AVS check. We have identified no concerns with the text, appendices, or attachments provided, however the current Tab 3, Attachment 3- 5, which was not amended, appears to be out-dated. Please submit a properly updated Attachment 3-5, Owner, Officer, and Director Information. 2. The map exhibits included in the amended Tab 3 materials (Exhibits 3-1, 3-2, 3-3, and 3- 4, were not certified by a qualified registered professional engineer or professional geologist, as required by Rule 2.10.3(2). Please provide properly certified original map exhibits. 2.04.9 Soils Resource Information and 2.05.4(21(dl Toasoil Handling Plan 3. Map Exhibit 9-3 Soil Survey Map was not certified by a qualified registered professional engineer or professional geologist, as required by Rule 2.10.3(2). Please provide properly certified original map exhibits. 4. Table 21-46 on page 27b was modified within the PR-04 submittal, but the notations at the bottom corners of the amended page erroneously indicate that the table was updated via PR03, Revised 7/02. Please provide an amended page 27b, with the correct revision reference and date. 5. Amended Exhibit 21-1,Topsoil Replacement, depicts postmining contours in green. The postmining contours were not extended into the proposed expanded Sage Creek/Wolf Creek pit area at the extreme southern end of the permit area, as would appear to be appropriate. Please amend the map as appropriate to accurately depict proposed postmining contours. 2.05.2 and 2.05.3 Ooeration Plan and Description 6. We note that certain information included on current Exhibit 12-3 has been deleted from the amended Exhibit 12-3 (e.g. topsoil stockpile locations and designated roads). We assume that this was a conscious decision, as it appears that all designated roads and stockpiles shown on current 12-3 are also depicted on Exhibit 13-2A. Please verify that this is the case. Table 12-1 was amended to include a highwall miner within the list of equipment, Exhibit 12-3 was amended to incorporate highwall mining, and new Attachment 12-4 was submitted to address the operational plan for the proposed highwall mining. Appropriate sections of the operation plan narrative text need to be amended to reference the proposed highwall mining and update the status and extent of auger mining that was conducted. Specifically, please update narrative references to proposed auger mining, and include appropriate reference to proposed highwall mining in narrative sections pertaining to the Lower Block and South Block, on pages 7 and 8 of the Tab 12 narrative. In addition, please amend the introductory section of Attachment 12-2 to update the current status and briefly summarize the extent of auger mining that was conducted at Seneca IIW.
