At this time, the Division is <br />willing to process this submittal as a minor revision because the <br />modifications consisted of updates or reformatting changes. <br />As you are aware, the Division wrote NOV C-90-026 following review of your <br />responses to questions 3 and 7. Abatement will consist of additional <br />reclamation monitoring this summer and submittal of a plan to augment the <br />woody plant density at the site. <br />The Division is proposing to approve this revision with one stipulation. A <br />revised drainage plan will be required if the Division makes a negative <br />determination on the generation of suspended solids from the site as part of <br />Phase II Bond Release. <br />If a revised drainage plan is required, the Division will want the small area <br />exemption section upgraded to meet the requirements of Rule 4.05.2(3). At <br />this time, the Division is aware of at least three small area exemptions: the <br />outlet and side slopes south of Pond 2; the area upslope of the area serviced <br />by Diversion Ditch D; and the area west of the cabin, adjacent to the break in <br />the permit boundary. <br />The Division is looking forward to receiving the acknowledgement from Wyf3ming <br />and Colorado Railroad Company, Inc. about the satisfactory reclamation at the <br />load-out. <br />Sincerely, <br />~~.,~"~~~~ 1,x.1 <br />Catherine W.
