Box 1299 <br />Paonia, CO 81428 <br />Re: Completeness Determination and Preliminary Adequacy Review, Technical <br />Revision to Permit an Access Road to the OVWM Vent Shaft and Water Tank <br />at the Orchard Palley Mine (Our File No. C-81-038 TR - 10) <br />Dear Mr. Koehler: <br />We have received your technical revision application to revise your permit <br />(File No. C-81-038) to conduct coal mining in Colorado. Our initial review <br />indicates that all preliminary items required by the Colorado Surface Coal <br />Mining Reclamation Act, C.R.S. 34-33-101 et seq., have been submitted; thus <br />your technical revision application has been~emed complete for the purposes <br />of filing on the above date. All review and comment periods as provided in <br />the Act and Regulations promulgated thereunder initiate from this date of <br />filing. <br />A copy of the technical revision application must be filed for public <br />inspection with the Delta County Planner or Clerk and kecorder. Any <br />subsequent changes or additions must also be made in this copy. <br />The proposed newspaper advertisement submitted with the application has been <br />found to be satisfactory, You should commence publication of this <br />advertisement as specified in Rule 2.07.3.(2) of the Regulations with the <br />exception that the publication need only be run once, and reference to the <br />informal conference specified in Rule 2.07.3(2)(d) should be deleted. Proof <br />of the publication of the advertisement must be filed with the Division as <br />soon as available after the publication date. <br />The staff has reviewed your technical revision application to determine <br />whether the items you have submitted are adequate in terms. We need proof, in <br />writing, that the surface landowner wishes the road in question to remain as <br />an access road following mining activity (Rule 4.03.2(1 )(f)(ii)).
