The published notice must meet the requirements of Rule
1.6.2(1)(d) of the Hard Rock Rules of the Mined Land Reclamation Board (Rules).
The DMG's determination is a result of the proposal in the AM-OS application to increase the Henderson
operations area of affected land in Grand County by 95 additional acres. If the substance of the notice (which
is the narrative of the notice not including the date of the deadline for public comments) is verbatim to the
notice of AM-OS previously published in the Clear Creek County Courant, then you do not need to republish
in the Clear Creek County Courant. Also, you do not need to re-notify landowners within 200 feet of the
affected land in Clear Creek County or Grand County if you have already notified those landowners.
In reference to your discussions with Allen Sorenson, the provisions formerly included in the Rules related to
informal conferences regarding permit applications were removed from the Rules. However, please rest
assured that the DMG will meet with Climax Molybdenum Company and any pertinent stakeholders on the
AM-OS application, and that the proceedings of any meeting will be on the record.
If you have any questions, please do not hesitate to contact Allen Sorenson or me.
cer y,
~~(~~° J
Ronald W.
