Long <br />Division Director <br />In a letter dated Mazch 5, 2002, Oxbow Mining LLC (OMLCC) requested the Division to <br />reconsider the determination of incompleteness for Permit Revision O5, Mine Plan Change. The <br />Division has considered the information you presented as discussed below. <br />The Sanborn Creek and Elk Creek permit application does include a discussion required by Rule <br />2.05.6(3) regarding the protection of hydrological balance. The Division can consider this section <br />to be complete. Adequacy of Rule 2.05.6(3) will be evaluated based on the inventory of <br />renewable resources discussed in the next pazagraph as well as other pertinent information in the <br />permit. <br />Rule 2.05.6(6) (a) of the Regulations requires that "the application shall include an inventory of <br />all structures and renewable resource lands which exist within the proposed permit and adjacent <br />area." On page 2.05-102 of the Sanborn Creek and Elk Creek pemut application there is a <br />paragaph titled "Inventory of Structures and Renewable Resource Lands". The pazagraph refers <br />to the General Facilities Map, Map 2.05-M1 (4 sheets) and to the Mine Plan Map, Map 2.05-M2. <br />Neither of these maps provides an inventory of resources lying above the proposed Elk Creek <br />mine. Please provide a map and discussion addressing Rule 2.05.6(6)(a) that will be incorporated <br />into Section 2.05 of the permit application. This is needed for the application to be considered <br />complete.
