Cottony <br />Division Director <br />Natural Resource Trustee <br />Listed below are adequacy review comments on the above-captioned amendment application to <br />increase the permitted acreage and disturbance from 3.0 to 9.9 acres. The decision date for your <br />application is scheduled for May 23, 2005. Therefore, I would appreciate a response from you on <br />or before May 18, 2005. Any public comments that we receive on your application during the <br />interim will be forwarded to you. Please be advised that your amendment application maybe <br />deemed inadequate and maybe denied on May 23, 2005 unless the following adequacy review <br />items are addressed to the satisfaction of the Division. <br />6.3.3 EXHIBIT C -Mining Plan <br />i. Please clarify the maximum height of solid vertical rock walls to be left in place during mitung <br />and final reclamation. <br />2, 1'lease.clarify,the maximum volume of overburden to be on site, then backfilled during a time <br />of maximum. disturbance: (Exhibit E-Reclamation Map specifies average thickness of <br />overburden replaced is about 2 - 6 feet). <br />3. Please clarify the highwall configuration(s) to be left during final reclamation. <br />6.3.4 EXHIBIT D -Reclamation Plan <br />4.
