This bankruptcy action has resulted in a court
approved rejection o1.'the coal supply agreement, and necessitated the seazch for a replacement
coal provider. Anew supplier has been selected and a new supply agreement is in the final stages
of negotiation. Samples of ash, obtained from test burns of the replacement coal supply, have
been submitted for laboratory analysis as a precursor to the submittal of this Technical Revision.
We have enclosed copies of the laboratory analysis (for both the fly ash and bottom ash), in the
same format as those submitted with the Annual Hydrology and Reclamation Report. A notice of
the change will be placed in the local newspaper as soon as we receive concurrence from CDMG
as to format and content. Copies of the Technical Revision application will be delivered to the
Keenesburg Town Hall and to the Weld County Clerk and Recorder's office for "public review"
once that approval is received and as soon as the notice is placed.
CEC believes that thE; documentation submitted is complete and sufficient for the processing of
this Technical Revision No. 35. However, should you have questions, please contact me at 303
277-3455.
Since
Donald W. MacDonald
Manager, Energy Services
enclosures
