Information at Garfield County <br />Dear Bill, <br />Last week I checked the county records to determine *.ahat information <br />related to the New Castle Energy (A?CEC) mining application is available <br />locally. The information is at the County Clerk and Recorder Office. Without <br />comparing this information to what you have in your office it is impossible to <br />determine if the DTCEC is providing identical information at the county level. <br />However, there appears to be at least one glaring discrepancy. On May 30, <br />1990. NCEC submitted a response to your adequacy letter of April 27, 1990. <br />Section 2.9 was amended with a copy of a coal lease agreement with private coal <br />owners. At NCECs' discretion, the coal company did not include a copy of this <br />lease in the material made available to the County Clerk and Recorder. In its <br />May 30, 1990 letter to you, DICEC explains that a portion of the lease was not <br />included in your copy because NCEC considers part of the sic?ned lease "non- <br />public information" which they will make available to CMLR on a confidential <br />basis. Please request that NCEC place a copy of the same lease copy they <br />provided CMLR in the County Clerk and Recorder office. NCEC apparently does not <br />consider the lease, or at least that portion of it, confidential and does not <br />have the discretion to exclude it from material required to be made available <br />locally. <br />Upon the most recer_t examinat <br />lease drafted By DTCEC.
