In 1977, the United States Congress pawed Public Iaw 95-87, the Surface
Mining Conti+ol and Reclamation Act (SMCRA) . This law prompted the Office of
Surface Minvxl and the states to promulgate varia;s regulations which currently
are being enforced by the coal ,rim states.
Under federal regulati.ori (30CFRB17.45 - Hydivlogic Balance: cc+d;ma.,h
Control ~a~,~) the following language can be found.
(a) Appropriate sediment amtrol ++~a+*+~ shall be designed, oaaZStructed aryl
mai.,ra;,,~ using the best technology currently available to:
1) prevem., to the extent possible, additional contributions of e~xi;,mnr tp
stream flow or to runoff outside the permit area;
2) meet the most stringent of applicable State or Federal effluent
limitations;
3) m;n;m;ze erosion to the extent possible.
(b) Sediment control +~~+,*~ include practices carried out within and
adjacent to the disturt:ed area. ale ~;+~*+*ation storage capacity in and
downstream fnmm the disturbed areas shall reflect the degree to which suocnssful
mining aryl reclamation techniques are applied to reduce erosion and control

and reclamation methods and ~;++~*+* cmrtrol practices, singly or in combination.
