Dear Mr. Burnell: We have received our copy of material transmitted to you by MCC dated February 11, 1999. This material is related to adequacy reviews being conducted by CDMG. We have reviewed iv1CC's map 52 titled B-Seam Mine Plan. That map shows longwall panels originating in federal coal lease COC56447 which also have bleeder systems developed on unleased federal coal in T 13 S, R 90 W, sections 13, 24, and 25. Those bleeder systems are at the east end of the longwall blocks, and are shown crossing the east boundary of federal lease COC56447. The map also shows longwall development and blocks on unleased federal coal in section 35 of the above described township as well as T 14 S, R 90 W, section 2. We are writing to you to recommend that MCC be required to adjust the aforementioned map to show their development and longwall panels scheduled during the current permit period strictly on coal property currently controlled by MCC. This would in no way preclude MCC from gaining the right to mine federal coal east of the boundary of federal lease COC56447 sometime withing the current permit period, but if that becomes the case, a mine plan revision would address the need in due time.
