<br />G82-056: Inimmal Conference. Mr. R ~Ik 3 <br />7) TCC had a question regazding inclusion of costs for removal of hazardous materials. <br />In relation to off-site disposal and landfill requirements petroleum based lubricants, <br />lead/acid batteries, flocculents, antifreezes, etc., aze considered hazazdous materials <br />and have specific disposal restrictions. The Division confirms that a letter from <br />Twentymile Coal Company to Colorado Department of Health, dated October 11, <br />1989, states that the maximum amount of hazardous material applicable to the <br />Wastewater Dischazge Permit No. CO-0042161, would be three 55-gallon drums of <br />ENACT 7883. ENACT' does not meet the requirements of RCRA, nor is it <br />regulated by CERCLA or SARA, so would not be considered hazazdous waste. The <br />Division will adjust these costs in the estimate. Should on-site inspections indicate <br />that materials considered hazardous for disposal purposes aze stored at the mine site, <br />then a cost estimate for their removal will be included in the estimate. <br />Additional questions identified by TCC during the conference aze still being reseazched. <br />Division responses to the remaining questions will be forwarded to you when available. <br />Please call if you need additional clarification, or have additional questions. <br />Sincerely, <br />Janet H.
