This <br />MR includes information requested in field MR 39, issued <br />April 16, 1993. Windrowed topsoil stockpile (PP) has <br />been added to Exhibit 12-1, Operations Map. Insert <br />revised Exhibit 12-1 into the Seneca II permit document <br />(Volume 11, Tab 12) and discard the old copy. <br />Abatement information required by NOV C-93-057, Item 3, <br />is also included in this revision. The disturbance <br />boundary, shown on enclosed Exhibit 12-1, has been <br />increased by 17.5 acres in the general location of the <br />NOV. The reclamation bond liability information is not <br />included at this time because the bond is being reviewed <br />with TR 27. As shown in TR 27, existing bond is in <br />substantial excess of reclamation liability. DMG <br />currently holds $11,673,859.00 in reclamation bonds for <br />the Seneca II Mine. Current liability was estimated by <br />Peabody to be $4,097,855.00. <br />Should you have any problem with this approach, please <br />contact me promptly since this submittal satisfies Item <br />3 of the NOV abatement. <br />Sincerely, <br />Gary W.
