Cottony <br />Division Director <br />Natual Resource Trustee <br />RE: Federal Mine Plan Modification Coordination, Technical Revision TR-104 <br />Mountain Coal Company L.L.C., The West Elk Mine, DMG Permit No. C-80-007 <br />Dear Mr. Bazbe: <br />On August 25, 2005, we received your August 25, 2005 application for Technical Revision TR- <br />104 to the West Elk Mine permit. I discussed this application with Mr. Cazl Johnston of the US <br />Office of Surface Mining in Denver today, and provided him with portions of the application <br />via facsimile transmission. <br />Based upon our discussions and upon the information provided to him, Mr. Johnston informed <br />me today that TR-104, if approved as currently described in the application, would not create <br />the need for modification of the federal mine plan for the West Elk Mine. <br />Should plans currently proposed in the TR-104 application change significantly during our <br />review of the application, Mr. Johnston will be informed. Significant changes in the <br />application during the review process may require Mr. Johnston to reverse his determination. <br />Should this reversal occur, we will inform you.
