I discussed this application with Mr. Cazl Johnston of the US
Office of Surface Mining in Denver today, and provided him with portions of the application
via facsimile transmission.
Based upon our discussions and upon the information provided to him, Mr. Johnston informed
me today that TR-104, if approved as currently described in the application, would not create
the need for modification of the federal mine plan for the West Elk Mine.
Should plans currently proposed in the TR-104 application change significantly during our
review of the application, Mr. Johnston will be informed. Significant changes in the
application during the review process may require Mr. Johnston to reverse his determination.
Should this reversal occur, we will inform you. Mountain Coal Company would at that time be
responsible for discussing with Mr. Johnston whatever steps the company would need to take to
obtain federal mine plan modification approval.
Please feel free to contact me at 303-866-4933 if you have any questions.
Sincerely,
,~(~
Daniel I.
