Catfany <br />Division DlfeCief <br />Natlrcal Resource Trustee <br />Re: Financial Warranty Submittal, Amendment Application (AM-02), Dawson Mine, M-1977- <br />392 <br />Dear Mr. Platt: <br />On June 10, 2003, the Division approved the Dawson Mine amendment application that <br />increased the approved permit azea to 42.35 acres. The Division increased the Financial <br />Warranty by $13,108.00. As noted on the approval letter, copy enclosed, the amendment revision <br />will not be final until the increase in bond is received and approved by the Division. To date, the <br />increase in bond has never been received so, therefore, the amendment approval is not final. <br />And, as a result, the proposed added acreage cannot be disturbed. If it is being disturbed, the <br />activity could be considered a possible violation of the Construction Materials Act for disturbing <br />acreage outside the approved permit azea. <br />In addition, pursuant to provisions of Rule 4.1(2), in part, "if these Warranties are not received <br />within one calendar yeaz of approval of an application for any new permit, amendment or <br />conversion, the Boazd shall hold a hearing to reconsider the previous approval."
