Surface lands ownership is Federal and private. OSM is <br />in agreement with the proposed decision and hereby provides OSM concurrence with the bond <br />release in accordance with 30 CFR 906.30(24). <br />DMG documented its bond release inspection findings in the proposed decision. The proposed <br />decision also documents the correct filing and advertising of the public notice and landowner <br />notifications. DMG did not receive any comments, objections, or requests for an informal <br />conference regarding the bond release application. The Bureau of Land Management issued a <br />concurrence on the release dated March 13, 2000. <br />This bond release concurrence is only an acknowledgment that the Edna Mine has met the <br />standards for Phase I bond release on the 258.0 acres identified in the application. The title page <br />of [he proposed decision references SL-7 as a final bond release, however, it is a Phase I release. <br />DMG holds a current performance bond for $5,042,176 for the entire Edna Mine area. DMG <br />proposes to release $464,143 of the performance bond for this Phase I release. Under separate <br />decisions, DMG has also proposed releasing $663,590 for bond release SL-6 and $74,599 for <br />bond release SL-5 on the Edna Mine. <br />If you have any questions, please contact Mitch Rollings at 303-844-1400 ext 1445. <br />Sincerely, <br />J~~~ ~= ~~ <br />James F.
