Wn¢ <br />Division Dlnclar <br />Re: Daniels Sand Pit 2, Revision Approval, Permit No. M-73-0075G, Revision <br />No. AM-001 <br />Dear Mr. Herskind: <br />On September 23, 1993 the Division of Minerals and Geology conditionally <br />approved the amendment application submitted to the Division on July 30, 1992, <br />addressing the consolidation of Permit Files M-73-007SG $ M-77-213. The terms <br />of the amendment No. 001 approved by the Division are hereby incorporated into <br />Permit No. M-73-0075G. <br />This amendment re suits in an increase in the current Financial Warranty <br />required for this 'permit from f882,000.0pto X1,038,500.00. This 1s an <br />increase of $156,SO0,00, Please provide an amendment to the current financial <br />warranty or submittal'of a new flnanclal warranty reflecting the increase. <br />Upon receipt of the increased reclamation bond, Permit No. M-77-213 will be <br />terminat and t flnanclal warranty for this site will be returned to <br />t Mix octet k-=M9t <br />The conditions of the Board approval are noted below. Please note that all <br />other provisions of Permit No. M-73-0075G remain to full force and effect- <br />Stipulation No. O1 <br />AS A RESULT OF MINING AND SIMULTANEOUS NATURAL SLOUGHING OF THE WORKING <br />FACE, THE HIGHWALL CONFIGURATION IS A NEARLY VERTICAL UPPER PORTION Of <br />THE NATURALLY O[CURRING SAND DEPOSIT WITH SLOUGHED SAND AT ITS ANGLE OF <br />REPOSE FROM THE PIT fL00R TO SOME POINT ON THE HIGHWALL. AT NO TIME <br />DURING MINING PHASES OF THE OPERATION WILL ANY VERTICAL PORTION OF THE <br />HIGHWALL EXCEED 35 FEET FROM THE TOPSOIL-STRIPPED GROUND LINE TO THE <br />TOP OF THE SLOUGHED SAND. <br />NO.B73 P.li2 <br />
