EXHIBIT A <br />Legal Description <br />The existing Wagner/Kauffinan Pit #3 permit (M-1999-069) consists of two properties, owned <br />by separate entities. Jake Kauffrnan and Son, Inc. owns the west half of the permit and the east <br />half is owned by Flying W Ranch Loveland, LLC. <br />The Jake Kauffrnan and Son, Inc. area currently consists of a portion of the SE '/4 of the SE '/< of <br />Section 17, a portion of the N % of the NE '/< of Section 20, and a portion of the NW %4 of the <br />NW '/< of Section 21, Township 5 North, Range 68 West of the 6th Prime Meridian, Larimer <br />County, Colorado. This area is approximately 131 acres. <br />The Flying W Ranch area originally consisted of portions of the NW %4 of the NE %a and the E 'h <br />of the NW %< of Section 21, all North of the Big Thompson River, Township 5 North, Range 68 <br />West of the 6th Prime Meridian, Larimer County Colorado. This area originally consisted of <br />approximately 102 acres. However, approximately 47 acres of the eastern portion of property <br />has been mined, reclaimed, and released from financial warranty by the Division. The area of <br />the property included in the proposed amendment consists of portions of the E %: of the NW '/o of <br />Section 21, Township 5 North, Range 68 West of the 6`h Prime Meridian, Larimer County <br />Colorado. <br />The current total permit area is approximately 186 acres. <br />This amendment consists of the aforementioned properties, as well as a portion of the land <br />directly south of the Wagner/Kauffinan Pit #3 permit area (see Exhibit B, Vicinity Map). This <br />southern portion is owned by Jake Kauffrnan and Son, Inc. and consists of approximately <br />55 acres in portions of the SE '/4 of the NE '/4 of Section 20 and the SW '/< of the NW '/4 of <br />Section 21, Township 5 North, Range 68 West of the 6th Prime Meridian, Larimer County, <br />Colorado. The 55 acres is currently part of the Kauffrnan Pit sand and gravel aggregate <br />extraction operation (M-78-327). <br />With the proposed acreage addition, the amended total permit area is approximately 241 acres. <br />Jake Kauffman and Son, Inc.
