Message <br />Kaldenbach, Tom <br />From: Hernandez, Dan <br />Sent: Monday, May 03, 2004 3:14 PM <br />To: Kaldenbach, Tom <br />Subject: Chimney Rock SL-05 <br />Page 1 of 1 <br />Hi, Tom -I've reviewed Janet Binns' memo of 4/30/04 regarding the proposed vegetaion sampling methodology <br />submitted along with the Chimney Rock SL-05 application. <br />Janet seems to have found that Kaiser's proposed sampling methodology is adequate for the mine's upcoming <br />Year 10 sampling. She has also determined that Kaisers 2003 vegetation sampling data indicate that the mine's <br />reclaimed areas have achieved Year 9 revegetation success. <br />She mentions in her memo, however, that, "the (Chimney Rock) permit text does not define the vegetation <br />sampling methodology to be used to determine reclamation success". It thus seems that Kaiser Ventures will <br />need to submit a technical revision to the Chimney Rock permit (per Rules 2.05.4(2)(e)(vi) and 4.15.7] to <br />incorporate the vegetation sampling methodology that Janet reviewed and found adequate. <br />Since Janet is out until Friday, would you mind touching base with the folks at Greystone (the consultants <br />that prepared the bond release app) and see if revising the permit (to incorporate the sampling methodology into <br />the permit as required by the Rules) is what they believe the next step is? <br />Thanks, <br />Dan <br />~]~ <br /> <br />/2 vas < vv. .z, ~ S~/3/ ~ 4' . <br />2S ~c~PM i.~~ <br />5/3/2004 <br />
