Rule 4.28.3(16) Points of compliance shall be established for any operation covered by 4.28 in <br />accordance with 4.05.13(1), if the Division determines that the operation has the potential to <br />negatively impact the quality ofgroundwater for which quality standards have been established <br />by the Water Quality Control Commission. <br />The potential is still undetermined. See Rule 4.05.13(1) above. <br />Rule 4.30 CESSATION OF OPERATIONS <br />The permit is in temporary cessation. <br />Rule 4.30.1 Temporary. <br />Rule 4.30.1(1) Each person who conducts surface or underground mining activities shall <br />effectively support and maintain all surface access openings to underground operations, and <br />secure surface facilities in areas in which there are no current operations, but operations are to <br />be resumed under an approved permit. Temporary abandonment shall not relieve a person of <br />the obligation to comply with any provisions of the approved permit. <br />There are no underground openings. The facilities have been secured (by locks) and gates (with <br />locks) at entrance roads, but there has been some damage by vandals. <br />Rule 4.30.1(2) Before temporary cessation of mining and reclamation operations for a period of <br />30 days or more, or as soon as it is known that a temporary cessation will extend beyond 30 days, <br />the permittee shall notify the Division. Within 90 days after notifying the Division, the permittee <br />shall submit to the Division a notice of intention to cease temporarily or abandon operations. <br />This notice shall include a statement of: <br />The operator has submitted such notice (letter of August 13, 2001). It meets the requirements of <br />subordinate rules. <br />Rule 4.30.1(3) As soon as a temporary cessation extends beyond 30 days, the operator shall <br />modify the mine identification sign to include the name, address, and telephone number of the <br />Division office where the mining and reclamation permit is filed. <br />The mine identification sign has been properly modified. <br />Rule 5.02.4(1) Copies of all records, reports, inspection materials, or information obtained <br />under these Rules by the Division or Board, except information identified as conf dential, shall <br />be immediately available to the public at the Division office and at a convenient place in the area <br />of mining to which the information pertains until the Division has terminated jurisdiction ut the <br />surface coal mining operation, pursuant to 3.03.3(1). <br />Page 37 of 38 pages, November 8, 2005 <br />
