Two sedimentation ponds collect runoff from the greater disturbed areas. A number of small area <br />exemptions (SAE) demonstrations (Tab 12-2) indicate that small azeas are in compliance. <br />However, the substation SAE calls for silt fencing, as does the office and leach field SAE, <br />and there is none for the water supply line. <br />Rule 4.05.3 Diversions and Conveyance of Overland Flow and Shallow Ground Water Flow, <br />and Ephemeral Streams Draining a Watershed Less Than One Square Mile. <br />There aze a number of properly designed ditches, along with culvert designs, for control of <br />overland flow from disturbed areas. <br />Rule 4.05.6 Sedimentation Ponds <br />Rule 4.05.6(3) Sedimentation ponds and other treatment facilities shall be designed, constructed <br />and maintained to: <br />The PAP is in compliance with this rule. Demonstrations are at 12-1A and B. <br />Rule 4.05.9(1) The design, construction and maintenance of all impoundments, including <br />sedimentation ponds, or other treatment facilities shall be in compliance with 4.05.9. <br />Compliance with 4.05.9 shall not relieve the person from compliance with all applicable Federal <br />and State water quality standards. <br />The PAP is in compliance with this rule. Pond 1 has separate primary and emergency spillways. <br />Pond 2 has a combined spillway. See Exhibits 12-3 and 12-4. <br />Rule 4.05.13(1) Ground Water. <br />A ground water monitoring program has been established that meets the requirements of this rule <br />with the exception of a point of compliance (see page 10 of Tab 13 of the PAP). <br />Rule 4.05.13(1)(a)(iii)CompBance with applicable ground water standards at established points <br />of compliance. <br />A point of compliance has not been established. See Rule 4.05.13(1)(b) below. <br />Rule 4.05.13(1)(b) One or more points of compliance shall be established for any coal operation <br />which, in the judgment of the Division, has the potential to negatively impact the quality of <br />groundwater for which quality standards have been established by the Water Quality Control <br />Commission. These points of compliance shall be monitoring locations in addition to any other <br />monitoring points required by the Division. <br />The Division has not made a determination that a point of compliance is required. <br />Page 31 of 38 pages, November 8, 2005 <br />
