Scott argued that they will not provide any useful data. I iterated our <br />position being 1) our rules require a monitoring plan beyond baseline data collection, 2) we need additional <br />samples from each well so thatwe can interpret the data and make a sound findings at bond release <br />concerning protection of the hydrologic balance, 3) The basic Standards for Ground Water (which we do <br />review) apply to all groundwater regardless of use classification, and 4) it is not an overly restrictive plan and <br />the requirements have already been reduced in the past. <br />Scott agreed to modify the language on page II.C-73 in permit. He stated that the language was vague on <br />sampling times and needed to be tightened up. <br />This is what I suggested to him: <br />Well 31-7 is an upgradient well and will not be mined out. This well should be sampled one more time prior to <br />bond release. The remaining wells are located within the longwall extraction area and should be sampled one <br />more time prior to mining through them. This will provide valuable information because these wells are <br />located downgradient and in some cases will not be mined out for 10 years. A reasonable time frame for <br />sampling each of the remaining wells would be 6 months prior to being mined out. I think with this situation <br />we need to specify a time frame in the language or they will continue to argue. <br />Overall, Scott was receptive to our discussion and agreed to change the permit language to reflect specific <br />sample times. Scott said that he would modify this language during the current permit renewal process. I told <br />him that if they had additional changes that they wanted to make it would have to be submitted for our <br />review. <br />I will assist you in reviewing the revised pages when you receive them.
