The Division currently holds a performance bond in the amount of $235,132.00. The Division <br />proposes to release $123,164.00 in conjunction with this proposed decision, retaining $111,968.00. <br />The last date of publication of the public notice published by Slurco Corporation of the filing of this bond <br />release request occurred on September 28, 1995. The Division completed its on-site inspection pertaining to <br />this bond release request on October 24, 1995. Regulation 3.03.2(3) of the Regulations of the Colorado <br />Mined Land Reclamation Board for Coal Mining allows persons to file an objection to the release within 30 <br />days of the latter of these two dates. No such objection was filed. The Division therefore found it <br />unnecessary to hold an informal conference on the requested release pursuant to Regulation 3.03.2(4) prior <br />to developing this proposed decision. <br />The Division has determined in accordance with Regulation 3.03.2(5) that there are no corrective actions <br />necessary for Slurco Corporation [o implement in order to secure this release request. <br />The written reasons for this proposed decision are found in the enclosed Proposed Decision Document dated <br />December 21, 1995. <br />You have a right, pursuant to Regulation 3.03.2(5), to request a public adjudicatory hearing with regazd to <br />this proposed decision. Adjudicatory heazings are described in Regulation 3.03.2(6).
