Rule 6.4.8 - do you wish to use the June, 2000 DOW letter to replace the existing Exhibit? As <br />~~/ stipulated in the Division's July 14, 2000 adequacy letter, the DOW letter does satisfy the <br />requirements of this Rule and is acceptable if you want to use it to replace the existing Exhibit. <br />11. Rule 6.4.19 -once the affected land boundary is delineated in the field and on the maps, the <br />applicant should review all the possible man-made structures within 200 feet of said boundary. A <br />fence is considered aman-made structure which, if not owned by the permit applicant, must be <br />~!~~ addressed pursuant to this Rule. A water well is considered aman-made structure. Buildings aze <br />man-made structures, roads aze man-made structures, and utility lines aze man-made strucrures <br />(culverts aze man-made structures also). All of the noted structures exist outside of the County's <br />property line. But, aze they more than 200 feet from the affected land boundary? This can only be <br />answered after the County delineates the affected land boundary. <br />Pursuant to Rule 1.6.2, the applicant shall mail or personally serve a copy of the published notice <br />to i) all owners of record of surface and mineral rights to the affected land and ii) all owners of <br />record of surface lands that aze within 200 feet of the boundary of the affected land. Prior to <br />~~ Division consideration of the application, the applicant shall submit proof of publication (this has <br />been received) and proof of al] required notices. So, Elbert County must submit proof that the <br />landowner of the proposed affected land was noticed and must submit.proof that all owners of <br />record of surface ]ands within 200 feet of the proposed affected land were noticed. Proof of. <br />notice may be by submitting return receipts of a certified mailing or by proof of personal service. <br />In addition, Elbert County must submit a copy of the Division's July 14, 2000 adequacy letter, <br />and a copy of your response,'to the Clerk and Recorder (which should not be recorded) and send <br />~~/ proof that the Clerk and Recorder received the documents. Plus, Elbert County shall submit a <br />copy of this letter, and a copy of your response, to the Clerk and Recorder (which does noc need <br />to be recorded) and submit proof to the Division that the Clerk and Recorder received the <br />documents. <br />If you need any assistance responding to this adequacy letter please let me know.
