9. Culvert C1-1B was planned to drain and buttress the south side of the <br />Administration Building. The culvert was designed but never installed. At this time <br />MCC has no plans to install the culvert. All reference to this structure is deleted and <br />the culvert will be removed from Map 54. <br />10. MCC has attached a copy of the Storm Water Management Plan for the Division's <br />files. <br />11. The ADS pipe installed from the substation downslope to ditch D1-3 is shown on <br />Map 54 and identified as C1-6A. The corrugated flexible plastic pipe is 18 inches in <br />diameter and 180 feet long. The designs for this pipe are found in Exhibit 66, and this <br />culvert is listed in Table 44. <br />12. MCC recognizes its responsibility in complying with the performance standards of <br />Rule 4.07.3. Further, MCC states that drill holes which have been permanently sealed <br />at the West Elk site have been sealed in conformance with the statutes and regulations <br />in force at the time of their drilling. For clarification, MCC has added language to <br />page 2.05-79. <br />13. MCC does not anticipate encountering or producing any acid or toxic forming <br />materials at the West Elk Mine. When page 3-80 of Exhibit 54 was written, the nature <br />of refuse material had not been positively established, therefore, there was the <br />possibility that refuse material or waste coal for that matter might be acid-forming. <br />Based on leachate tests in Exhibits 13 and 56, MCC determined that waste rock and <br />coal refuse to be placed in the refuse pile was not acid- or toxic forming as conceived <br />by the regulations. This assertion is further backed by the Division's approval of 18-24 <br />inches of non-toxic, noncombustible cover for placement over West Elk's refuse pile. <br />A material handling plan is not needed. Nevertheless, MCC is editing the referenced <br />page 3-80 of Exhibit 54 to clarify the lack of acid- and/or toxic forming materials. <br />-4- <br />
