1. Currently, Colowyo is approved to submit their quarterly pond inspections reports <br />annually in the Annual Hydrology Report. Rule 4.05.9(14)(b) states that the "...professional <br />engineer shall, promptly after each inspection required by 4.05.9(14), provide the Division, a <br />certified report..." The Division requests that Colowyo submit a revision to the permit <br />that changes the language in the permit to reflect that the pond inspection reports will <br />be submitted to the Division on a quarterly basis, rather than yearly. Upon making this <br />change, Colowyo will no longer be required to submit the quarterly pond inspection <br />reports with the Annual Reclamation Report. <br />Response: Colowyo will submit quarterly pond inspections on a quarterly basis as requested. Colowyo <br />requests that this commitment does not commence until the ftrst quarter of 2008. This will <br />allow Colowyo to submit all the 2007 quarterly inspections in the 2007 Annual Reclamation <br />Report, and the first quarter 2008 quarterly report will be submitted at the end of the first <br />quarter (March 2008). Colowyo will discontinue the submittal of quarterly inspections in the <br />Annual Reclamation Report beginning with the 2008 ARR. <br />2. Pursuant to Rule 4.05.9(14), please ensure that, during construction and upon <br />completion, the Engineer certified inspection reports for the West Taylor Pond, Section <br />21 Pond and Section 28 Pond are submitted to the Division. Please include, if <br />necessary, a certified pond as-built drawing or clearly make note in the inspection <br />report that no field changes were made to the approved pond design. <br />Response: Colowyo will submit the necessary documentation in accordance with Rule 4.05.9(14) during <br />and after construction is complete on the West Taylor Pond, Section 21 Pond, and Section 28 <br />Pond. <br />3. Currently Colowyo has nine outstanding stipulations (stipulation 2-10). The status of <br />each stipulation is detailed below along with any new, pertinent information regarding the <br />stipulation. <br />a. Stipulation 2.• Prior to disturbing any lands in the Lower Wilson area, the Colowyo <br />Coal Company shall provide the Division with a PERMIT revision containing a mine plan <br />and a reclamation plan and any additional baseline monitoring information (surface water, <br />ground water, soils, vegetation, etc.) requested by the Division. The approval of Permit <br />Revision 02 is only an approval for disturbance in the South Taylor Pit (South Taylor Pit, <br />West Valley Fill, East Valley Fill and associated structures). NO DISTURBANCE IS <br />APPROVED FOR THE LOWER WILSON AREA WITH THE APPROVAL OF PERMIT <br />REVISION 02. This stipulation is a future compliance issue that must be addressed <br />prior to any mining in the Lower Wilson Area. <br />Response: As previously agreed upon by Colowyo and the Division during Permit Revision 02, Colowyo <br />will submit a mine plan, reclamation plan, and an additional baseline monitoring <br />information prior to commencing any mining in the Lower Wilson area. <br />b. Stipulation 3: Prior to disturbing the Lower Wilson area the Colowyo Coal Company <br />shall perform further archaeological investigations on seven areas identified as requiring <br />more detailed study in the October 1984 report titled, "Cultural Resources Investigations in <br />the Danforth Hills Proposed Coal Lease Area; Moffat and Rio Blanco Counties, Colorado; <br />
