The <br />Division of Reclamation, Mining and Safety (Division) is required to make an approval or denial <br />decision no later than November 13, 2006. Therefore, your response to the following adequacy <br />review concerns should be submitted to the Division as soon as possible. <br />1.6.2 -General Applicant Procedures <br />As required by Rule 1.6.2 (1)(g), please submit the proof of publication of the public <br />notice circulated in the local newspaper, notice to all owners of record of surface and <br />mineral lands, easement holders, and owners of record of surface lands that aze within 200 <br />feet of the boundary of the affected land. Proof of notice may be return receipts of a <br />Certified Mailing or by proof of personal service. The Public Notice provided within the <br />original Conversion Application Package was posted in the Akron News-Reporter on April <br />20, 2006. However, this Conversion Application Package was not deemed complete until <br />August 15, 2006. Therefore, a new public notice must be posted according to Rule <br />1.6.5(1). The Public Notice, as required in Subpazagraph 1.6.2(1)(d) shall be published <br />four times, once a week for four consecutive weeks. Pursuant to Rule 1.6.5(2), within ten <br />(10) working days after the last publication or as soon thereafter as proof has been <br />obtained, the Applicant shall mail proof of the publication required by Rule 1.6.2(1)(d) to <br />the Office. Proof of publication may consist of either a copy of the last newspaper <br />publication, to include the date published, or a notarized statement from the paper. An <br />application may not be approved until such proof has been obtained. In addition, in the <br />case of a 112 Reclamation Permit Application, such written comments, protests, and <br />petitions for a hearing must be received by the Office not more than twenty (20) calendar <br />days after the last date for the newspaper publication of notice of the application provided <br />for in Rules 1.6.2(1)(d) and 1.6.5(1). <br />2. Please submit the following information for all permanent structures within 200 feet of the <br />affected area, including all utilities and easement holders: <br />a.
