Proposed Public Notice <br />Application for Release of Liability <br />Nucla Mine, Montrose County, Colorado <br />Permit C-81-008 <br />Peabody Coal Company, 1300 S. Yale, Flagstaff, Arizona 86001 has filed an <br />application with the Colorado Mined Land Reclamation Division (CMLRD) for <br />release of liability on 55.6 acres in the Nucla Mine permit area (Permit <br />C-81-008, initially approved by the CMLRD on May 26, 1983), in order to <br />facilitate expansion of the Montrose/San Miguel County Landfill. The <br />lands proposed for release of liability are described as: <br />Portions of the S# S} and N} S}, Sec. 25 T47N, R16W <br />The 7.5 minute USGS Quadrance map shows the above described area. Surface <br />owners are Montrose County and San Miguel County. <br />The 55.6 acres included in this application for release of liability <br />are included in the Nucla landfill certificate of designation issued by <br />Montrose County on December 20, 1988. The CMLRD approved the change in <br />land use on this acreage from dryland pasture to industrial/commercial on <br />February 28, 1969. Because the landfill will expand into existing mined <br />out pits, no backfilling or grading has occurred in this area so that the <br />County may conduct its landfilling operation efficiently. There is <br />sufficient spoil material available in the area to meet the backfill <br />requirements of the landfill. Therefore, reclamation standards for the <br />industrial/commercial (ie. landfill) land use have been met. <br />The current reclamation bond held by CMLRD for Permit C-81-008 is <br />$1,730,280. At this time Peabody is not requesting a reduction in the <br />bonding level at Nucla Mine. The purpose of this application is to <br />release Peabody from liability on that area which will be operated as a <br />landfill by the surface owners. Therefore, the bond currently held by <br />CMLRD will remain sufficient to insure reclamation. <br />Written comments, objections, and requests far a public hearing or <br />informal conference on this application for release of liability may be <br />submitted to the Colorado Mined Land Reclamation Division, 215 Centennial <br />Building, 1313 Sherman Street, Denver, Colorado 80203, (303-866-3567), <br />and must be received by the Division by June 19, 1989. <br />
