,; <br />.~- <br />Mr. Stover Page 3 <br />Preliminary Adequacy Review <br />10. In order to leave the sediment pond in place after bond <br />release, it must meet the criteria of a permanent impoundment <br />detailed in rule 4.05.9(1). Most importantly, is rule 4.05.9(1)(b) <br />which states, "The level of water shall be sufficiently stable and <br />the configuration of the pond shall be adequate to support the <br />intended use". In regards to leaving the haul road after bond <br />release, please see rule 4.03.1(1)(f), which states that all haul <br />roads shall be removed unless the road is compatible with the end <br />land use and the landowner requests, in writing, that the road or <br />certain portions of the road are to be left open for future use. <br />It is possible to reduce the size of the haul road to a one-way <br />light-use road, in addition to meeting the other two requirements. <br />If MINREC chooses to leave the pond and road, an application for a <br />technical revision must be submitted to the Division. <br />Please note that with the exception of question $10, none of the <br />required information will require a revision. The information is <br />determined to be minor in nature and can be addressed within the <br />renewal process. <br />Please call if you have any questions. <br />Si <br />Christine E.
