The following aze the Division's comments and questions. <br />Item number 6 is a new comment. <br />The application form for TR-37 shows tha[ there will not be an increase in the acreage <br />for affected land. However, this TR would change the mine plan to add 117.79 acres of <br />federal coal through the federal lease modification plan. Rule 1.0=f(7) def nes affected <br />land jot underground mines as those lands directly above the mine workings This would <br />include lands within the angle of draw. Please modify the application form to include the <br />acreage increase in affected lands, as defrned in Rule 1.0=1(7). <br />The Division has no further concerns. OMI revised the revision application form to add <br />167.9 acres to the permit azea, 167.9 acres to the federal acreage and 126.4 acres to the <br />affected area. <br />Please update the operation plan in Section 2.05.3(1) of the permit application to include <br />a discussion ojthis lease modifcation and permit boundary change. <br />The Division has no further concerns. OMI revised permit pages 2.03-10 and 2.03-12. <br />Please verify that there are no structures or resources in the affected area that have not <br />already been accounted for in the Sanborn Creek dline permit npplication. <br />OMI has responded that they are not aware of any new structures or resources in the area <br />in question that are not listed in the permit application.
