Dudash -2- February 5, 2007 <br />BRL: Please see the enclosed report prepared by Buckhorn Geotech, dated February 1, 2007, <br />titled Geotechnical Report, Stability Evaluation of Coal Waste Pile No. 4, Delta County, <br />Colorado. <br />12. DRMS: Please provide a stability analysis [Rule 4.09.1(7)] using the material characteristics <br />requested in item number 9 above in the vicinity of cross section D - D'. The design stability <br />safety factor needs to be 1.5 [Rule 4.10.4(2)]. The configuration should be the proposed cut <br />slopes (original ground) approved by TR-43, and the proposed finished surface of the fill, as <br />illustrated for cross section D - D' on Figure 1 of the application. <br />BRL: Please see the enclosed report prepared by Buckhorn Geotech, dated February 1, 2007, <br />titled Geotechnical Report, Stability Evaluation of Coal Waste Pile No. 4, Delta County, <br />Colorado. <br />15. DRMS: Attached is the reclamation cost estimate for TR-44. The estimate is seven tasks (a <br />summary sheet and Tasks 171-176) and represents an increase in liability of $285,366.00. The <br />Division's estimate is considerably more than the estimate of $49,565.00 submitted by BRL.In <br />the submittal dated December 26, 2006, BRL stated that they accept the Division's reclamation <br />cost estimate of $265,457 for TR-44. However, the total bond amount for TR-44 is $285,366.00, <br />as shown on page two of the cost estimate. Please reconfirm <br />BRL's acceptance of the reclamation cost estimate. <br />BRL: BRL agrees with the reclamation estimate <br />21. DRMS: The Appendix B summary table on page App B-8 still needs to be revised with <br />updated ditch design information. <br />A revised Appendix B summary table page App B-8 was provided in the January 3, 2007 <br />submittal. However, as mentioned in item number one above, several revisions to the summary <br />table still are needed. <br />BRL: Please see revised attached Appendix B <br />In addition to the information referenced above, the thirteen page narrative for Volume IX is <br />enclosed.
