We apologize for being late with our comments; <br />however, we were unable to respond since we did not receive BRL's adequacy review submittal <br />until July 12, 2005. , <br />We have reviewed the above submittal and have the following remarks. <br />In your letter of July 14, you wrote that the State's jurisdiction ends with the emergency <br />spillway at the base of the Pond F embatllatlent and does not include the remaining <br />channel structures. As a result, we request that Rip Rap Ditch (as shown on Section B <br />and Section C of Figure 4 - Pond F Emergency Spillway), from the base of the Pond F <br />embanlanent to the Fire Mountain Canal (Canal) to the end of our easement, be <br />compacted in 6-inch lifts to 95 percent of maximum density as specified by ASTM D- <br />698-OOa. Since much of the embanlar7ent for this Rip Rap Ditch above and below the <br />steel flume will need to be added to bring it to the finished grade or final ground as <br />shown in Figure 4, we believe that a good compaction effort should be required on this <br />material to ensure stability of this Rip Rap Ditch. Please note that our Canal easement is <br />100 feet wide (50 feet each side from centerline). <br />• The detail for the Steel Flume (shown in Figure 3 -Coal Mine Waste Disposal Area Pond <br />F Detail, dated 6/6/05) mentions that the flume will tie into the bridge steel for stability. <br />Please clarify the location and stability of the bridge steel since we are unaware of the <br />bridge containing steel. On our site visit on March 8, 2005, we did not note any steel on <br />this bridge. <br />• We request that BLR provide Reclamation and the Fire Mountain Canal and Reservoir <br />Company (Company) 48 hours prior notice before construction on the emergency <br />spillway channel and installation of the flume begins. The point of contact with <br />Reclamation is Bob Major (970-248-0613), and Merritt Denison is with the Company <br />(970-234-9198). <br />
