Box 106 <br />Delta, Colorado 81416 <br />Re: Mowbray Gravel Operation <br />File No. M-79-166 <br />Dear Mr. Darrow: <br />Pursuant to our telephone conversation of this date, enclosed please find the <br />following items: 1) Copy of our copy of Cease and Desist Order from the U.S. <br />Army Corps of Engineers to Mr. Ron Kinne for activities associated with the <br />above captioned mining operation; 2) Succession of Operators form; 3) 110 <br />Permit Application form (to be used to update administrative information); <br />4) Performance Warranty form (to be filled out and signed by successor <br />operator), 5) Financial Warranty forms including corporate surety, letter of <br />credit and certificate of deposit options (to be submitted by successor <br />operator or lessee of pit are a, if different than successor operator); and <br />6) a copy of bond number BND 311 92 71 in the amount of $1,500.00 from the <br />Continental Insurance Company. <br />As I explained to you, a complete succession of operators package for this <br />operation should include a completed succession of operators form (with an <br />authorized representative of the estate signing for the late Mr. Mowbray), a <br />completed 110 application form (just the form, no new exhibits needed), a <br />performance warranty and a $1,500.00 financial warranty. Once such a <br />completed package is submitted, our staff can review it for adequacy and <br />schedule the request for consideration by the Mined Land Reclamation Board. <br />I am also concerned about the on-the-ground status of this operation, given <br />the violation found last spring by the U.S. Army Corps of Engineers. I <br />strongly advise you to visit the site (or have an informed third party visit <br />the site) to compare activities on the site to permit provisions. Any <br />discrepancies should be rectified as soon as possible by changes (amendment or <br />technical revision) to the permit.
