• <br />2. Response adequate. <br />PERMANENT MANMADE STRUCTURES <br />1 . Please identify the owners of the various fences within 200 feet of the affected area. Fences on <br />property boundaries need ownership clarification. The demonstration that those fences will not be <br />affected is acceptable. <br />2. The railroad is a very important structure, disturbance of which could cause great harm to those <br />parties that rely on its services. This structure and the associated communication line, and their site <br />specific conditions (high water table, loading the crest of the slope with the sight berm) do warrant a <br />true engineering demonstration that they will not be affected by the mining. Please provide either an <br />adequate damage waiver from the owners of these structures, or submit an engineering demonstration <br />that these structures will not be damaged by activities occurring at the mining operation. Keep in mind <br />that catastrophic slope failure generally does not allow time for reconciliation of the problem before it <br />causes the majority of it's disturbance. <br />COMPLAINT LETTER <br />On October 28, 1997, the Division received a letter from Ms. Dewsnup withdrawing her objections. No <br />further objections to this application were received.
