Regarding Note 5 on the maps, any temporary stockpiles must also be outside the offsets <br />required for slope stability. <br />Note 4 (previously Note 5) was modified. It now reads, "Temporary stockpiles are not <br />shown. They will vary in size and shape and will be located inside the disturbance boundary <br />of each phase and outsides the offsets required for slope stability." <br />6. Based upon the applicant's decision to only incorporate discharge of water to the South <br />Platte River in this amendment appldcation, Note 10 is no longer applicable and must be <br />removed from the maps. <br />Note 9 (previously Note 10) was modified. It now reads, "Prior to crossing the Lupton <br />Bottom Ditch and Brighton Ditch, Lafarge will obtain all necessary agreements. Lafarge will <br />discharge into the South Platte River only unless there is an agreement in place with the <br />Ditch companies." <br />Note 11 and the note marking the 400' from-top-of-streambank boundary could be <br />interpreted to mean that only submission of a bank stability plan or analysis to the Division <br />is necessary to mine within this area. Please clarify these statements to indicate that <br />anyroval of such a plan by the Division is necessary to comply with Stipulation No. I of the <br />permit. Additionally, as noted in the April 22, 2005 adequacy review, aJlood analysis and <br />,flood control plan must be submitted to and approved by the Division prior to mining within <br />400' of the top of the South Platte riverbank. <br />Note 11 was modified. It now reads, "Per Stipulation 1, prior to mining within 400' of the <br />Platte River, Lafarge will submit a Bank Stabilization Plan; Flood Analysis; and Flood <br />Control Plan to the DMG for approval. Mining with 400' of the South Platte River will not <br />occur until the DMG has approved a Bank Stabilization Plan; Flood Analysis and Flood <br />Control Plan." In addition, a hatch pattern has been added to the plans to identify the area <br />between the 200' and 400' offsets from the South Platte River. In the Legend this hatch <br />pattern represents areas where no mining will occur without DMG approval of a South Platte <br />River Bank Stabilization Study. <br />8.
