ORDER <br />Based on the foregoing findings of fact and conclusions of law, the Board orders that the <br />application of Aggregate Industries-WCR, Inc. for the Colley Reservoir and Fulton <br />Wildlife Area site, File No. M-1999-034, is hereby approved, with the following <br />conditions: <br />1) No de-watering or extraction activities will occur until Aggregate Industries <br />develops a plan to monitor the gravel pit pond water for diisopropylmethylphosphonate <br />(DIMP) and obtains approval of that plan from the Division of Minerals and Geology. <br />The plan will include monthly sampling and analysis to begin immediately after de- <br />watering and/or extraction activities are started. The monthly monitoring will continue <br />for one year and then will change to quarterly monitoring until the Division issues a letter <br />authorizing discontinuance. The plan will include the sampling and analytical methods to <br />be used and an agreement to submit the results of the analysis to the Division within 30 <br />days of the sampling date. The samples will be obtained and analyzed by a company, <br />individual, or agency certified to do the work. If an analysis shows a level of DIMP <br />exceeding 8ug/L, Aggregate Industries or its agent will immediately notify the Division <br />by certified mail and include a response plan to deal with the contaminant, and to prevent <br />on-site and off-site damage. If the Division determines from the monitoring data that <br />there is reasonable potential for the operation to cause groundwater quality standards for <br />DIMP to be exceeded, the Division will notify Aggregate Industries to modify the permit <br />as necessary to comply with Subsection 3.1.7 of the Rules. <br />2) Aggregate Industries shall sample Karen Topper's domestic water supply well, <br />permit no. 2455, for DIMP prior to and after de-watering begins, and shall submit the <br />results to the Division and to Ms. Topper within 30 days of the sampling date. <br />DATED this ~~ day of ® y ~ , 2003. <br />FOR THE COLORADO MINED LAND RECLAMATION BOARD <br />arry Jave c Vice Chairman <br />Mined Land Reclamation Board <br />8 <br />
