r' ~ ~ <br />vacated, title to the vacated roadway shall vest in the owners of the abutting land, <br />each abutting owner taking to the center of the roadway. <br />43-2-303 Methods of vacation. (2) (a) No platted or deeded roadway or part <br />thereof... shall be vacated so as to leave any land adjoining said roadway without <br />an established public road or private access easement connecting said land with <br />another established public road. <br />The provisions of section 43-2-202 require that the road be split between the <br />property owners adjoining either side of the road. The County would require the signature <br />of the property owners of lots on the opposite side of Fremont Street agreeing to the road <br />vacation. Upon completion of the road vacation it would be up to the property ~~wners to <br />deed their portion of the vacated road to Mr. Laughrey. <br />The vacation of the road may not deny any property access to their property under <br />section 43-203. Although all of the lots in Block 1, Florissant AM No. 1 (west o1` Fremont <br />Street) are under common ownership, they are still separate parcels and may be sold <br />individually. Access to any individual parcel may not be eliminated by the road vacation, <br />alleyways would not be considered adequate access. The access issue could be <br />addressed if the owners of the Block 1 would be willing to vacate the individual) property <br />lines to create one parcel, and if adequate access from Wildhom Road or Buenas Vista St. <br />exists. <br />The application for vacation of the road has not been submitted to the Planning <br />Department to schedule a hearing before the Board of County Commissioners.
