Simpson, Assistant State Engineer <br />SUBJECT: Delta Sand & Gravel Conversion - #77-20 <br />Application for Mining and Reclamation Permit <br />As requested by your office, we have reviewed the application for a gravel <br />pit near Delta. The applicant mentions that the lake will be reclaimed for <br />private recreation and a habitat for wildlife. We view this use of gravel <br />pit water as putting the ground water to a beneficial use which would thus <br />make the pit a "well"; and in order to construct the "well", a well permit <br />must be obtained in order to not be in violation of CRS 1973, 37-90-137. <br />We have no objections to the application as long as the applicant obtains <br />the needed well permit. <br />9~/~ U • L <br />Hal D.
