Simpson, Assistant State Engineer
SUBJECT: Delta Sand & Gravel Conversion - #77-20
Application for Mining and Reclamation Permit
As requested by your office, we have reviewed the application for a gravel
pit near Delta. The applicant mentions that the lake will be reclaimed for
private recreation and a habitat for wildlife. We view this use of gravel
pit water as putting the ground water to a beneficial use which would thus
make the pit a "well"; and in order to construct the "well", a well permit
must be obtained in order to not be in violation of CRS 1973, 37-90-137.
We have no objections to the application as long as the applicant obtains
the needed well permit.
9~/~ U • L
Hal D.
