Banta. <br />Division Duector <br />The public comment period on the proposed approval decision for Bond Reduction <br />at the Grassy Gap Mine ended November 12, 1990, with no public comment. The <br />Office of Surface Mining objected to our bond release in the inspection report <br />which the Division received on October 30, 1990 on the basis that the amount <br />released exceeded the sixty percent allowed under a Phase I Bond Release. No <br />official objection was filed within the public comment period and as this mine <br />had historically been designated as a non-Federal mine, the Division is <br />proceeding with the bond release per the June, 1950, Settlement Agreement <br />between Rockcastie Coal Company and the Colorado Mined Land Reclamation <br />Division. <br />The bond had been set at E572,000 for reclamation of the site and the <br />Division's decision released $437,696. The outstanding reclamation liability <br />at the mine is $134,304. Therefore, we are releasing Letter of Credit <br />No. 108-334 dated May 7, 1986, in the amount of $446,680. Please find the <br />May 7, 1986 Letter of Credit enclosed. <br />We are in receipt of an approved replacement <br />Jamesville, Wisconsin.
