Should you agree, please provide designs for the Refuse Contour Ditch for <br />~~i ~ ~~r <br />the 100-year, 24-hour event. For the purposes of expediency, these designs could be <br />p ~r ~ addressed as a stipulation if you prefer. <br />Whether or not the Refuse Contour Ditch is upgraded, Figure 17-1 indicates that it joins <br />the Refuse Collection Ditch at a right angle. Please provide a discussion addressing how <br />this intersection will be stabilized. <br />~((~ 5. EFMC's response to Item 9 is satisfactory. <br />6. With respect to EFMC's responses to Item No. 13, and in conjunction with Item No. 4 of <br />bl~ this letter, clean water diversions above refuse piles are permanent features and may not <br />be removed. Construction of the Post-Mining Ditch is prudent, however, given the <br />potential for the diversion above the ditch to silt in and breach the diversion at that point. <br />Please submit designs and demonstrations for the conveyance channel extending from <br />the outlet of Post-Mining Ditch 1 to Refuse Collection Ditch 1. <br />e~ 7. EFMC's response to Item 15 is satisfactory. <br />off- 8. As stated herein, the diversion ditches above the refuse pile cannot be approved for <br />removal. Please revise your response accordingly. <br />9. EFMC's response to Item No. 18 is satisfactory. <br />10. With respect to Item No. 20, please describe what, if any, other sediment control <br />vli• measures, as described in Rule 4.05.5, will be used at the Raton Creek Mine in addition <br />to the upland diversions, the sediment pond, the catchment basins, the Refuse Contour <br />and Collection Ditches, the silt fence at the Trailer SAE, and the existing system of <br />berms, roadside ditches, culverts, and riprapped channels currently proposed or <br />previously approved. <br />p~ 11. EFMC's responses to Items 21, 22, 23, 24, 25 and 26 are satisfactory. <br />Please provide responses to these items as soon as possible.
