(Aggregate Industries) is providing <br />this response to the Colorado Division of Wildlife comments regarding the above <br />referenced amendment application. <br />The .applicant has been in contact, via telephone, with Mike Sherman of the Division of <br />Wildlife, and the greatest concern expressed by Mr. Sherman was with regard to the bald <br />eaglets in the area of proposed aggregate mining. The limits of mining as set forth in the <br />application are, at leas[, one-quarter mile southwest of [he confluence of St. Vrain and <br />Boulder Creeks. According to Mr. Sherman's letter to the Division of Mining and <br />Geology (DMG), dated December 14, 2000, the eagle roosting site is in the area of the S[. <br />Vrain Creek and Boulder Creek confluence. While Mr. Sherman's letter does not <br />identify the exact location of the roost, i[ is the applicant's position that proposed mine <br />limit:~ (as shown on amendment application Exhibit D) will provide an adequate buffer <br />zone from the eagle roosting site. <br />Mr. Sherman indicated by telephone that the eagles may use the mining azea as a hunting <br />ground, and therefore recommended that mining be restricted on the Longmont property <br />betwl;en November 15 and March 15. Eagles have been seen around the existing project <br />site, and the mining operations have not been shown to be detrimental to the eagles. <br />Furthermore, prairie dog towns outside the areas of disturbance will provide hunting <br />grounds for the eagles. It is therefore the applicant's position that restrictions relative [o <br />mining only between March 15 and November 15 will not be necessary. <br />The proposed mining plan does not anticipate disturbance of a significant number of <br />existing trees.
