I have finished my review of Seneca's responses to the Identification of Interests
questions in our November 24, 1998 adequacy review letter for the Seneca Il-W Mine.
The information is relevant for all 3 Seneca mines. The forn~at of this letter conforms to
the adequacy letter format. The file is located at m:\coal\mpb\senamem2 and
m:\coal\sb 1 \senamem2.
1. A check of [he AVS has turned up a "conditional issue "for Seneca Coal Company.
The company tors been linked [o seven violations, slx of the violations are from
Kentucky and one is from West Virginia. Seneca does not have to own or operate
the mine that has received cr violatial in order for Seneca to be linked to the
violation. According [o Colorado regulatlotts, the link to a violation can occur
because an individual in one cotnpany was related to another company wlzicli had
received the violation.
The Kenlucby violations involve a company called Cntmvba and have been
covered previously ir: permit stipulations for the three Seneca mines. However, the
West Virginia violation, which involves the company called Mar/inka, is new and
needs to be added to the stipulations. The Division will revise the appropriate
stipzlations for [tae three Seneca mines and contact Seneca about these revisions.
The Division will revise the appropriate stipulations for all three mines at the time
of revision approvals. Seneca has agreed to this.
