The following issues have been raised which need to be addressed. <br />Additional adequacy concerns. if any, will be forwarded to you as they occur. <br />In conjunction with the Succession of Operator soon to be filed by NCEC, <br />changes have recently been made to the "Identification of Interests" section <br />of the Colorado regulations (Rule 2.03.4). These changes are detailed in <br />Attachment A of this letter. The new rules require submittal of information <br />on each person who "Owns or Controls" the applicant under the definition of <br />"OWNED OR CONTROLLED" and "OWNS AND CONTROLS" in Rule 1.04(83a1. Neither the <br />Permit Revision nor the Succession of Operator application can be approved by <br />the Division until all information under these rules is provided. <br />Figure 3.3-1 shows only wells in the vicinity of the proposed site, while <br />Rule 2.04.7(41 also requires the mapping of water supply intakes, ditches, and <br />reservoirs within a one-mile minimum radius. This rule also requires a map of <br />"current users of surface water flowing into, out of, and within a hydrologic <br />area defined by the Division .. ". This Figure should be updated, or an <br />additional map of the same hydrologic area provided to include this <br />information, which can be obtained from a Colorado Division of Water Resources <br />water rights listing. <br />Figure 3.3-1 also maps wells YY, ZZ, and AAA through FFF which are not in the <br />corresponding list on page 3-5. What is "GW" in the Aquifer column of this <br />list? If it is possible to determine the locations of the wells reported in <br />Exhibit 3.3-1, particularly the Ideal Cement well, this would be very useful <br />in determining the Probable Hydrologic Consequences. <br />If power lines are already in place or are to be installed, they must be <br />mapped according to Rule 2.05.3(3)(al. NCEC should also indicate any steps <br />which have been or will be taken to prevent electrocution of raptors <br />(Rule 4.18.41. <br />
