<br />the site, specifically the pits and the rock channel between Pits #3 and #4. Remaining work includes revegetation <br />and weed-control efforts throughout the site. <br />Your letter references a permit for the extraction of sand and gravel and questions why trucks are hauling material <br />to the site, why there is a cement manufacturing plant and why there is a retail landscaping business on site. <br />Please note that the Division issues a Mining and Reclamation Permit, which allows for the extraction and <br />reclamation of the affected lands. The Division does not regulate truck traffic to and from the site. Typically, the <br />local county authority governs truck traffic. <br />Regarding the landscaping business, the Construction Material Rules and Regulations do not regulate such <br />activity, only how the stockpiled material pertains to the reclamation bond. At a minimum, the operator will only <br />need to address that this activity is: taking place in the yard area in the approved mining and reclamation permit. <br />Tltis is to ensure that the area used for stockpiling is properly reclaimed and this cost is included in the <br />reclamation cost estimate. The sits: facilities noted in your letter, specifically permitting the cement plant, was <br />approved by the Division April 26, 1994 (in Technical Revision 002). As noted above, the operator will not be <br />required to reclaim the facility area until 5 years after mining and reclamation is completed. At that time, the <br />operator will need to address reclamation of the facility or change the reclamation plan to industrial use in order to <br />remove it from the mining and reclamation plan. <br />I hope that the Division has addre:;sed your additional concerns noted in your April 17, 2000 letter.
