Frei, we request that you
continue the applicant's meeting with the Board on the subject
mine from the regular May, 1985 meeting to the regular July, 1985
meeting. we assured you that the Final Plat would be approved for
the May hearing but the county proved us wrong. We apologize for
the inconvenience we may have caused the staff and board in making
that statement.
This continuance is necessary because we still trying to
resolve zoning matters with Clear Creek County. Mr. Bert Weaver
stated in a phone conservation on May 21, 1985 that the county was
prepared to give Mr. Frei preliminary approval of the final plat.
He assured me that the final approval would be ready for the June
hearing of the MLRB. We are requesting the extension to July
because of the location of the June hearing. Paonia is in an out
of the way location and is inconvenient for myself and Mr. Frei to
attend since our offices are located in the Denver area. We also
are not convinced that the Clear Creek County will have the final
plat approved for the June hearing.
For your information Mr. Frei will be in compliance, except in
Stage Z where a cease and desist had been ordered, with the state
and county as soon as the county approves the final plat. He has
posted a bond in the amount of $41,000 and the only thing before
the Board will be the approval for the completation of Stage Z and
permission to fill part of Stage 1 as outlined in the Amendment up
for approval.
Sincerely,
e~~~~ ~~
Stevan L. O'Brian
Vice President
cc: Albert R. Frei
