relocated to the Mayflower Tailings Pond 4, in accordance with Rules 3.1.5(5), (10), <br />(11) and 3.1.6. <br />3. The application indicates that removal of the pre-permit tailings and reclamation <br />grading will return the floodplain to its approximate original elevation and restore its <br />approximate original capacity. One pond may result, approximately 0.5 acres <br />surface area, and will be situated to provide a sediment trap for drainage from Hwy <br />110. Such a pond, located within the floodplain, will enhance the capacity of the <br />floodplain. However, the map submitted with TR-26, locates the pond along the <br />outside edge of a meander in the channel, where erosive energies are <br />concentrated. The map shows the pond to be located within 100 feet of the <br />highway and within 100 feet of the Animas River channel. Pursuant to Rules <br />3.1.5(3) and 3.1.6(3), please address the potential for such a pond to adversely <br />affect the stability of the river channel during flood flows associated with the 100- <br />yearevent and potential impacts to the stability of Hwy 110. <br />4. The application indicates that the 10.56 acres affected lands, referenced in TR-26, <br />are previously disturbed areas where topsoil is not available for reclamation <br />purposes. The application proposes to revegetate the 10.56 acres area by applying <br />a seed mix composed largely of grasses but without the benefit of a topsoil layer to <br />support the grasses. Floodplain areas, void of topsoil but sub-irrigated by shallow <br />groundwater, may be more appropriately vegetated with deep rooting riparian <br />species, such as willow shrubs. Please clarify how affected lands will be <br />revegetated to satisfy the performance requirements of Rule 3.1.10(1). <br />5. The application states that surface drainage from the Mayflower Tailings Ponds <br />area will be routed through the referenced area in a lined ditch. The ditch outlets to <br />the Animas River at the approximate high water elevation. Please provide <br />additional details for the ditch outlet, showing how the design ensures stability of the <br />ditch during high flows within the river. <br />6.
