The revision was submitted by Trapper Mining Inc. All review and
comment periods as provided in the Act and the Regulations initiate from this date of filing.
The applicant proposes to conswct a sediment convol pond on approximately ].5 acres of land within the existing mine permit
area in the SW I/4 NEI/4 Sec. 32, T6N, R90W. The location is approximately 4 miles south of Craig, Colorado and is shown
on the Castor Gulch 7.5 minute, USGS topographic quadrangle map.
Because the above referenced technical revision application would alter previously approved permit conditions or mitigation
measures, we are requesting your agency's evaluation of the potential for impacts to threatened or endangered species of plants
or animals, or wildlife species otherwise protected by federal law.
In order for us to approve this revision, we are required to make a finding that "the activities would not affect the continued
existence of endangered or threatened species or result in the destruction or adverse modification of their critical habitats as
determined under the Endangered Species Act of 1973...." We request your review and recommendation pursuant to this
finding. Depletion to the upper Colorado River basin from the proposed pond will not cause total depletion from the Trapper
Mine to exceed the 130.39 acre-feet previously reviewed by your agency. Please advise us if you require additional
information.
A copy of the technical revision application is available for public inspection at the Moffat County Courthouse, 221 W Victory
Way, Craig, CO 81625, and at the Division office. For additional information or to provide written comments, concoct the
Division of Minerals and Geology, Room 215, 1313 Sherman Sveet, Denver, Colorado 80203, (303) 866-3567. In order for us
to comply with regulatory time frames, we request that comments be submi«ed within fifteen (IS) days of this letter. If no
comments are received by then, we will proceed on the assumption that you have no concerns with, or objections to, the
applicant's proposal.
Sincerely,
T~r.tl~.~.~2~
Tom Kaldenbach
Environmental Protection Specialist
Enclosure(s)
