<br /> <br />t~ the Mined Land Reclamation Division of the Department of Natural Resources <br />of the State of Colorado in order to reimburse Lessor for any amounts she <br />might be required to pay the State of Colorado under her aforesaid bond. <br />During the term of this lease, the Mined Lard Reclamation Commission requires <br />a bond in a increased amount from the Lessor, then the Lessee shall likewise <br />increase the amount of his bond, certificate of deposit or bank letter of <br />credit in favor of Lessor. <br />SECTICN ELEVII9 <br />DEFAULT BY LESSEE <br />In the event any default occurs in the performance of any term <br />or condition of this lease by Lessee, Lessor shall have the right to <br />give athirty-day notice in writing to Lessee, demarriing the correction <br />or removal of such default. Irr the event Lessee fails to correct or <br />r~nove such default within such period, Lessor may, at her option, <br />terminate this lease. If this lease is terminated by Lessor pursuant to <br />this section, Lessor shall have such additional rights against the <br />Lessee as may result from any damages caused to the premises or for any <br />damages resulting to the Lessor because of the failure of the Lessee to <br />follow the rules aryl regulations of the mining permit and of the Army <br />Corps of Engineers. Lessee shall have sixty days after such te~+~nation <br />in which to remove any plant, structures, or equipment placed on the <br />leased premises by Lessee. <br />If the lease is so terminated by Lessor, Lessor shall have a <br />lien upon all material stockpiled on the leased premises or Lessor's <br />premises for any aryl all unpaid royalties due Lessor urrler the terms of <br />this lease. <br />SECTION T[~LUE <br />RIC;t-PPS TO ADDITIC~IAL MII~RALS <br />If any m;narals, as distinguished from sand, gravel, rock, and <br />dirt, shall be found on the leased premises, the same shall belong to <br />Lessor, but Lessee shall have the first right and option to mine the <br />same under such terms and conditions as Lessor is then ready and willing <br />to lease the same to any third person. <br />SECTION THIRTEEN <br />FUEL STORAGE FACILITIES <br />Any fuel storage facilities will be bermed to prevent any fuel <br />spillage from contaminating adjacent ground or waterways as per mining <br />safety and health administration regulations. Fire extinguishers will <br />be placed by the Lessee in appropriate locations. <br />Lessee shall place at his own cost and expertise "No Trespassing" <br />signs at regular intervals along the leased premises and access routes. <br />5 <br />
