i <br />• • <br />Lessee may erect a plant or plants on the leased premises, if <br />it should so desire, to process materials thereon. Lessee may also <br />erect such buidlings and install such machinery and equipment as may be <br />useful in cronnection with its operations hereunder. <br />Lessee shall have the right to drill water wells on the leased <br />premises for use in connection with mining operations thereon. On <br />permanent cessation of the use of any such well, or on termination of <br />this lease, Lessee shall leave such well and the casing therein for the <br />use of Lessor, but Lessee may remove any pumps or motors. Lessee shall <br />also obtain the necessary water well drilling permits and follow all <br />other state and local rules and regulations in connection therewith, in <br />the event it desires to drill such a well or wells. <br />SECTION FIXTR <br />DAMAGE TD LIVESTOCK, CROPS, AND IMPROS~T~N'TS <br />Lessee will repair any damage done to storage tanks and other <br />similar improvements on the leased premises, and Lessee will pay the <br />reasonable value of any livestock and crops that may be killed, injured, <br />destroyed, or damaged by Lessee's agents or employees and belonging to <br />Lessor, as well as carry liability insurance as hereinafter provided. <br />SECTION FIVE <br />PI37TECTION OF PREMISES <br />Lessee agrees to provide and install adequate gates at all <br />entrances into areas of the leased premises being used or occupied by <br />Lessee. Such gates will be kept locked during the hour of darkness, and <br />at all times when such areas are not occupied by Lessee's personnel. <br />SEL^TIO?V SIX <br />P%YI'EK,TION AND RESTORATION OF SURFACE <br />In digging pits for the purpose of producing and removing <br />materials hereunder, Lessee agrees to make separate stockpiles of topsoil <br />and of waste substances. Lessee agrees that on carpletion of the removal <br />of materials from pits that have been dug on the leased premises, Lessee <br />will replace any unused waste substances and materials used for roadways <br />back into the pits from which such substances and materials were removed, <br />with topsoil placed on top, and that the Lessee will back-slope such <br />pits, using such substances and materials as have been removed from such <br />pits. <br />Lessee agrees that it will follow all rules and regulations of <br />the rlined Land Reclamation Division of the Department of Natural Resources <br />of the State of Colorado as well as of the Corps of Engineers of the <br />Cepartment of the Army of the United States. In Particular Lessee will <br />follow all rules and specifications of these two orginizations in the <br />mining of materials and in the reclamation of the permitted area. <br />3 <br />
