Our initial review <br />indicates that all preliminary items required by Rule 2.08.4(5) have not been submitted. Thus, your application is incomplete <br />for the purposes of filing as of April 28, 2005. <br />The following information needs to be provided in order for the Division to conduct our review: <br />Removal of azeas (G-strike pit located in TSN, R90W, Section 5) already approved for topsoil stripping and <br />mining, included in the current 5-yeaz mine plan, and included in the reclamation cost liability would constitute a <br />reduction in liability as per Rule 3.02.2(5). Although MR-199 proposes additional areas to be included in the <br />disturbed area so the net balance of acreage removed from the mine plan and that added balances out, the area <br />removed would still need to be evaluated as a liability reduction. Reduction to reclamation liability costs cannot be <br />conducted via a minor revision. A reduction in liability must be evaluated via a permit revision or a technical <br />revision. In order to remove the G-strike pit areas from the reclamation liability, MR199 will need to be <br />withdrawn and resubmitted with the requested information as a technical revision. <br />2. Conflicting projected topsoil laydown maps were submitted with TR95 and MR199. These projected 2005 topsoil <br />maps need to be in agreement. <br />3. MR199 proposes F-pit extension to the south ofthe existing pit in TSN, R91 W, S'/: NE'/. Section 1. This F-Pit <br />extension would breach the ridgeline and appears to disturb the steep south facing slope in the West Horse pond <br />watershed. The approved post-mining topography map M12, shows the post-mining topography in this proposed <br />disturbance area as the original native slope. Please explain how TMI will re-establish these post-mining contours <br />so as to achieve the 1.3 factor of safety required by Rule 4.14.2(1)(b). <br />In accordance with Rule 2.07.3(1), you have the opportunity to amend, review, or otherwise make your application complete. <br />if you have any questions, please contact me. <br />Sincerely, <br />Janet H.
